Comprehensive Warranty Coverage for Fencing,
Landscaping, Irrigation & Concrete Work

At BNB Property Services, we’re proud to deliver high-quality craftsmanship backed by professional, transparent warranty coverage. Below is our comprehensive warranty policy outlining terms, customer responsibilities, and coverage limitations for all fencing, landscaping, irrigation, and concrete services. This warranty has been drafted to comply with relevant provisions of the Colorado Consumer Protection Act (CCPA) and applicable construction-related statutes, including C.R.S. Title 13, Article 20, and Title 6, Article 1.

Section 1: Fencing & Gate Warranty

1.1 Fence Installation – 5-Year Limited Warranty
BNB Property Services warrants fence installation workmanship for five (5) years. Coverage includes: –
Post alignment and anchoring – Panel installation and structural integrity – Proper gate hardware
installation – Fence line leveling and support

1.2 Covered Fence Types

  • Wood Fencing: Frame integrity and post placement
  • Vinyl Fencing: Material installation and connection security
  • Chain Link Fencing: Fabric tension and secure post setting
  • Ornamental Iron and Steel: Proper anchoring and straightness
  • Custom Fencing: Includes horizontal, board-on-board, and decorative configurations

1.3 Material Warranty
BNB provides workmanship warranties. Materials are only warrantied if the manufacturer provides written product guarantees. BNB does not assume responsibility for product defects unless explicitly covered under
a manufacturer warranty.

1.4 Wood Disclaimer
Wood is a natural product and subject to warping, checking, splitting, shrinking, swelling, or discoloration.
These conditions are normal and are not covered by warranty.

1.5 Stain Warranty – Wood Defender Products
If BNB applies Wood Defender stain: – 2-Year Warranty for Transparent Stain – 3-Year Warranty for Semi-Transparent Stain Warranty is void if: – Sprinklers hit the fence regularly – Customer fails to maintain or reapply sealant when needed – Fence is stained by another party or product

1.6 Gate Warranty

  • Custom Fabricated Gates and Wood Frame Gates are covered for one (1) year against sagging, latch failure, or structural shifting due to installation error
  • Gate alignment adjustments are covered during the first year
  • Gates are not warrantied for misuse, abuse, slamming, or forced entry

Section 2: Landscaping Warranty

2.1 Coverage Terms

  • Sod Installations: 30-day limited warranty for proper establishment
  • Tree, Shrub, Perennial, and Annual Installations: 90-day limited warranty with one-time replacement if conditions are met

2.2 Conditions for Coverage

  • A fully functional, properly adjusted irrigation system must be in place and verified during postinstallation inspection.
  • BNB will conduct a post-installation inspection within 7 business days.
  • Client must follow care instructions provided by BNB, including watering, mowing, and mulch care.
  • Any concerns regarding plant health or system performance must be reported to BNB within 24 hours of first observation.

2.3 Lawn Mowing Requirement

  • Sod warranty will be void if the Client fails to mow at the appropriate height (3″–4″) and interval after rooting has occurred.
  • Early mowing (before rooting) or skipped mowing contributes to poor sod health and will invalidate coverage.

2.4 Absentee Maintenance

If the Client is unable to maintain the lawn or inspect the property due to travel or other reasons, BNB offers maintenance visits at $75 per visit, which include:

  • Irrigation function check
  • Watering verification
  • Visual inspection of sod and plant health
  • Written summary with recommendations

2.5 Exclusions

  • Damage from pets, pests, equipment, weather, or vandalism
  • Decline due to a lack of supplemental watering during adverse weather
  • Any unreported issues outside of the 24-hour notification window

Section 3: Irrigation System Warranty

3.1 New Irrigation Systems – 1-Year Limited Warranty

BNB warranties newly installed irrigation systems for one (1) year covering:

  • Leaks from faulty installation
  • Malfunctioning valves, zones, or controller setup
  • Spray pattern coverage issues due to design flaws

Note: This warranty is only valid if BNB performs both the Spring Start-Up and Winter Blow-Out services.

3.2 Irrigation Repairs – 30-Day Limited Warranty

  • Applies to components and zones repaired by BNB
  • Does not cover existing system faults outside the repair scope

3.3 Exclusions

  • Freeze damage due to third-party or self-winterization
  • Controller or system tampering by others
  • Poor performance caused by water supply issues
  • Damage from vehicles, digging, pets, or weather

Section 4: Concrete Work Warranty

4.1 Standard Warranty Coverage – 1 Year
BNB warranties concrete flatwork and decorative concrete for one (1) year from the date of installation.

4.2 Covered Services

  • Driveways, walkways, patios, pads, stairs, and footers
  • Stamped, colored, or textured concrete

4.3 What’s Covered

  • Improper slope, pitch, or drainage
  • Surface flaking or spalling due to workmanship
  • Structural cracking over 1/4″ caused by poor base or joint placement
  • Settlement of over 1/2″ not linked to external forces

4.4 Exclusions

  • Cosmetic cracking, surface crazing, or minor hairline cracks
  • Discoloration, shading, and curing variation in decorative concrete
  • Weather-related damage, salt/chemical damage, or staining
  • Physical damage from vehicles >10,000 lbs or heavy equipment
  • Damage caused by improper maintenance, such as early traffic or harsh cleaners

4.5 Customer Responsibilities

  • Keep foot traffic off concrete for 48 hours; no vehicles for 7 days
  • Avoid de-icers during the first winter
  • Use only approved sealers or have BNB apply
  • Report issues within 24 hours of observation

4.6 Optional Concrete Curing Visits ($75)

  • Visual inspection
  • Watering (if necessary due to conditions)
  • Basic protection assessment
  • Photo documentation and report

Section 5: Filing a Warranty Claim

To initiate a claim:

  1. Submit a written report within the applicable warranty period and within 24 hours of noticing an issue.
  2. Include: – Description of the problem – Photos showing the defect or concern – Date of installation and date of issue observation
  3. BNB will inspect the site and determine if the issue is covered under warranty. Remedies may include:
  • One-time replacement of material
  • Repair of the affected area
  • Partial refund or credit at BNB’s discretion

Section 6: Media and Marketing Use

BNB Property Services may take photographs or videos of your project during and after completion for documentation and marketing purposes. This may include:

  • On-site photography during construction
  • Finished project photos
  • Use of media on our website, social media platforms, advertisements, and printed materials
  • Placement of temporary yard signage for marketing during and shortly after project completion

By hiring BNB, the Client grants BNB permission to use such media unless a written request for exclusion is submitted before or at the time of service.

Section 7: Legal Limitations

7.1 Force Majeure
BNB Property Services shall not be liable for any failure or delay in performance under this warranty or any related agreement due to causes beyond its reasonable control. This includes, but is not limited to, acts of
God, natural disasters, severe weather conditions, labor shortages or disputes, delays in material delivery, governmental restrictions, or acts of war or terrorism.

7.2 Dispute Resolution
In the event of a dispute regarding warranty coverage, workmanship, or service quality, both parties agree to first attempt informal resolution. If the dispute is not resolved within 30 days of written notice, the parties agree to resolve the matter through binding arbitration conducted in accordance with the rules of the American Arbitration Association in the State of Colorado. Each party shall bear its own legal costs unless otherwise determined by the arbitrator.

7.3 Contract Supremacy
This warranty is subject to the terms of the signed service agreement, contract, or estimate provided by BNB Property Services. In the event of any inconsistency or conflict between this warranty and the signed agreement, the terms of the signed agreement shall prevail.

7.4 Non-Disparagement and Defamation
By hiring BNB Property Services, the Client agrees not to publish, post, or distribute false, misleading, or defamatory statements about BNB, its employees, or its work, whether verbally, in writing, online, or through any social or public media. Reasonable, fact-based reviews and criticisms are protected under applicable law; however, knowingly false statements may be subject to legal action for defamation or business interference.

  • Warranties are non-transferable and apply only to the original Client and service address.
  • BNB is not liable for indirect or consequential damages.
    This page constitutes the complete and final warranty agreement and supersedes all verbal or informal representations.
  • This agreement complies with applicable Colorado law, including consumer protection and
    contractor-related statutes under C.R.S. Title 13 and Title 6.
